Annex III 3: the common specifications used

Revised 2026-10-26.

EHDS Annex III point 3 (EUR-Lex): “The references to any common specification used in accordance with Article 36 and in relation to which conformity is declared.”

Art. 36(1) has the Commission adopt, by implementing acts, common specifications for the essential requirements of Annex II, and Art. 36(4) presumes conformity with the requirements they cover. As of 2026-10-06 no implementing act under Art. 36 has been adopted. The two EHDS implementing acts adopted so far, and vendored in the FerroEHR repository, have other legal bases: Implementing Regulation (EU) 2026/2083 (MyHealth@EU, Art. 23(4) and (8)) and Implementing Regulation (EU) 2026/2099 (cross-border identification and authentication, Art. 16(2)). The European electronic health record exchange format of Art. 15(1), which Annex II 2.1 to 2.3 name, has not been adopted either.

FerroEHR’s EU acts watcher (.github/workflows/eu-acts-watcher.yml) files an issue for each act adopted under the EHDS. When an Art. 36 act is adopted, it is vendored in FerroEHR’s docs/law/eu/, each Annex II row of the readiness record is re-read against it, and this page names the specification and the parts applied, and the copy each release relies on names its version.
